A Bill to require courts, local authorities and other bodies, when determining or enforcing issues of residence and contact, to operate under the presumption that the rights of a child include the right to grow up knowing and having access to and contact with both of the parents involved in the residence or contact case concerned, unless exceptional circumstances are demonstrated that such contact is not in the best interests of the child; to create an offence if a relevant body or person does not operate under or respect such a presumption; and for connected purposes

Ten Minute Rule Bill

On 29 March 2011, Tory MP Charlie Elphicke proposed a bill aiming to require courts and local authorities to take into account the rights of a child to grow up seeing both parents when determining custody arrangements.
The bill would make it an offence for a relevant body to disregard this presumption.
Mr Elphicke argues children who see both parents have better education and employment prospects in later life.

That this House believes that children are entitled to the love, guidance and support of both parents and a relationship with their wider family after separation and divorce unless certain restrictions apply, to ensure children can enjoy the benefits this gives; further believes in the desirability of creating a legal presumption of shared parenting orders if necessary, meaning parents are equally responsible for their children and those children spend a significant proportion of their time with each parent; and calls on the Government to recognise this need for a presumption of shared parenting in the family justice review.

That this House notes that child benefit can only be paid to one parent; further notes that this unnecessarily discriminates against the other parent where parents are separated and maintain shared custody of children; further notes that this can further discriminate against one parent by preventing access to suitable housing and additional income to allow them to provide for children; further notes that this can lead to restricted access for one parent to see their children; and calls on the Government to take action to address these problems.

Complementary – #Equality (Netmums: Presumption of shared parenting discussion and vote)

Somebody raised an interesting point.

A new Shared Parenting Bill that has been presented to Parliament.

The draft text indicates that these would be new Court Orders that would need to be applied for, rather than an actual legal presumption of Shared Parenting without the need for confirmation by a judge.

What are your views of the concept of Shared Parenting and if there was an automatic legal presumption, rather than having to apply for it?
